Privacy policy

This is an English translation of our German privacy policy (Datenschutzerklärung). If the two versions differ, the German version applies.

1. Controller

The controller responsible for data processing on this website within the meaning of the General Data Protection Regulation (GDPR) is:

Monte Oli DOO
XVI, Lokal broj 7
Budva, Montenegro
Represented by the managing director Juri Oliferenko
Phone: +49 6373 89 76 002
Email: noreply@monteoli.me

Monte Oli is based in Montenegro, i.e. outside the European Union. Because our offer is also aimed at people in the EU, the GDPR applies to this website (Art. 3(2) GDPR).

2. General information on data processing

We only process personal data to the extent necessary to operate this website, provide our content and handle enquiries and entries on our interest list, where we are legally obliged to do so, or where you have given your consent. Personal data is any information relating to an identified or identifiable person, for example name, address, email address or IP address.

Below we explain which data we process, for what purpose and on what legal basis.

This website does not set cookies and does not use any analytics, statistics or advertising services. No content is loaded from third-party servers; the video at the top of the page is also stored on our own server.

3. Hosting and server log files

This website is hosted by Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus. When you visit the website, the server automatically processes information transmitted by your browser (server log files): IP address, date and time of access, page requested, amount of data transferred, referrer URL, browser type and version, and operating system.

This data is technically necessary to deliver the website and to ensure its stability and security. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in the secure and trouble-free operation of the website. The log files are deleted automatically as soon as they are no longer needed for these purposes; the exact period is set by the host. They are only kept longer if they are needed to investigate a security incident.

The host processes this data exclusively on our behalf, on the basis of a data processing agreement pursuant to Art. 28 GDPR.

4. SSL/TLS encryption

For security reasons, this website uses SSL or TLS encryption. You can recognise an encrypted connection by "https://" in the address bar and the lock symbol in your browser. When encryption is active, the data you send to us cannot be read by third parties.

5. Fonts

The fonts used on this website are stored locally on our server. No connection to third-party servers is established when the page is loaded.

6. Interest list

You can sign up for our interest list on this website. Your name and email address are required. You may also provide your place of residence, your phone number, your budget, your house preferences (number of bedrooms, wishes such as sea view or pool, planned use) and a message.

We use this information to inform you by email about new houses from Monte Oli. Your preferences also help us plan our houses. The legal basis is your consent (Art. 6(1)(a) GDPR), which you give by ticking the box in the form.

Email confirmation (double opt-in): After you submit the form, we send you an email with a confirmation link. We only add you to the list once you have confirmed your entry with this link. This ensures that nobody can sign up someone else's email address. Until you confirm, your details are stored on our server. If you do not confirm within 7 days, they are deleted there automatically. After confirmation, our web server sends your details by email to our mailbox and deletes them from the server. To be able to prove your consent (Art. 7(1) GDPR), we record the date and time of your entry and of your confirmation. The legal basis for the confirmation email and this record is our legitimate interest in being able to prove consent and in preventing misuse (Art. 6(1)(f) GDPR).

To protect against mass sign-ups, the server stores a check value (hash) of your IP address, not the address itself, together with the time when you submit the form. Entries older than one hour are deleted the next time the form is used. The legal basis is also Art. 6(1)(f) GDPR.

You can withdraw your consent at any time, for example with a short email to noreply@monteoli.me or by replying to one of our emails. We will then delete your details from the list. Unless you withdraw your consent, we keep them for as long as we offer new houses and can inform you about them.

7. Contacting us

If you contact us by email or phone, we process your details (e.g. name, contact details, content of your enquiry) in order to deal with your request. The legal basis is Art. 6(1)(b) GDPR if your enquiry relates to a contract or steps prior to entering into a contract, otherwise Art. 6(1)(f) GDPR; our legitimate interest lies in answering enquiries. We delete the data as soon as your enquiry has been dealt with and no statutory retention obligations apply.

8. Recipients

We do not pass your data on to third parties and do not sell it. Apart from us, only service providers who take care of the technical operation on our behalf (hosting, website support, email) have access, and only to the extent necessary for this.

9. Storage period

We only store personal data for as long as it is necessary for the respective purpose, as long as you have consented, or as long as statutory retention obligations (in particular under commercial and tax law) require. The data is deleted afterwards.

10. Your rights

You have the right at any time to

You can withdraw any consent you have given at any time with effect for the future (Art. 7(3) GDPR). This does not affect the lawfulness of processing carried out before the withdrawal.

Right to object (Art. 21 GDPR): If we process your data on the basis of Art. 6(1)(f) GDPR (legitimate interest), you can object to this processing at any time on grounds relating to your particular situation. If we use your data for direct marketing, you can object to this at any time without giving reasons.

For all requests, a message to noreply@monteoli.me is sufficient.

Right to lodge a complaint: You can lodge a complaint with a data protection supervisory authority (Art. 77 GDPR), in particular in the EU member state of your habitual residence, your place of work or the place of the alleged infringement.

Obligation to provide data: You are not required by law or contract to provide your data. However, without your name and email address we cannot add you to the interest list.

There is no automated decision-making, including profiling, within the meaning of Art. 22 GDPR.

11. Updates

We adapt this privacy policy when our website, the services we use or the legal situation change.
